CERN Open Hardware Licence Version 2 - Strongly Reciprocal Preamble CERN has developed this licence to promote collaboration among hardware designers and to provide a legal tool which supports the freedom to use, study, modify, share and distribute hardware designs and products based on those designs. Version 2 of the CERN Open Hardware Licence comes in three variants: CERN-OHL-P (permissive); and two reciprocal licences: CERN-OHL-W (weakly reciprocal) and this licence, CERN-OHL-S (strongly reciprocal). The strongly reciprocal variant of the CERN OHL is intended for use in cases where the Licensor wishes to ensure that all Derivatives of the Covered Source remain freely available under the terms of the licence and that products incorporating Covered Source or Derivatives thereof be made available to any recipient under the terms of section 3 of this licence. Please read the licence carefully before using it or applying it to your hardware design or product. TERMS AND CONDITIONS 0 Definitions 0.1 'Licence' means this CERN-OHL-S. 0.2 'Compatible Licence' means a) any version of the CERN-OHL-S, or b) a licence which permits its licensees to treat the text of its terms and conditions as if it were a later version of the CERN-OHL-S, provided that such licence: i) also provides for the patent non-aggression clause under section 8 of this licence; and ii) also provides for a notice and disclaimer requirement under sections 5 and 6 of this licence. 0.3 'Source' means information such as design materials or digital code which can be applied to Make or test a Product or to prepare a Product for use, Conveyance or sale, regardless of its medium or how it is expressed. It may include Notices. 0.4 'Covered Source' means Source that is explicitly made available under this Licence. 0.5 'Product' means any device, component, work or physical object, whether in finished or intermediate form, arising from the use, application or processing of Covered Source. 0.6 'Make' means to create or configure something, whether by manufacture, assembly, compiling, loading or applying Covered Source or another Product or otherwise. 0.7 'Available Component' means any part, sub-assembly, library or code that: a) is licensed to the recipient under terms that permit it to be used, modified, Conveyed, and Used to make a Product; b) is generally commercially available; and c) is reasonably acquirable by the recipient without undue effort or resources. An Available Component need not be licensed under this Licence. A Product which comprises only Available Components is not a Covered Source. 0.8 'External Material' means anything which is: a) incorporated into a Product, or into Covered Source; or b) used to Make a Product, but which is not itself a Product; or c) incorporated into, or used to Make a Product which is not itself a Product; and which is not part of the Covered Source. 0.9 'Derivative' means any work which is derived from or based upon all or part of the Covered Source, including a circuit or mechanical design derived from the Covered Source, or any documentation based on or incorporating the Covered Source. 0.10 'Convey' means to communicate to the public or to distribute. 0.11 'Upstream Licensee' means the Licensor(s) who provided to the Licensor the Licence for the Covered Source. Any Upstream Licensor is not a party to this Licence. 0.12 'Notice' means copyright, acknowledgement and trademark notices, references to this Licence, and modifications to the Source, in each case as included in or attached to the Covered Source. 0.13 'Licensor' means any person who creates or modifies Covered Source. A person may be a Licensor and a recipient at the same time. 0.14 'Recipient' means any person who receives the Covered Source, including all Contributors. 0.15 'Contributor' means any person who modifies the Covered Source. 0.16 'User' means any person who Makes a Product. 1 Applicability 1.1 This Licence governs the use, copying, modification, Conveying of Covered Source and Products, and the Making of Products. By exercising any right granted under this Licence, You irrevocably accept these terms and conditions. 1.2 This Licence is granted by the Licensor directly to You, and shall apply worldwide and without limitation in time. 1.3 You shall not attempt to restrict by contract or otherwise the rights granted under this Licence to other Recipients. 1.4 This Licence is not intended to restrict fair use, fair dealing, or any other legally recognised limitation or exception to copyright. 2 Internally Used Source 2.1 You may use Covered Source internally for the purposes of study and research without obligation to comply with section 3 of this Licence. 2.2 Any Modifications made by You to the Covered Source must be documented in the Source in a human-readable form and dated. 3 Conditions for Conveying Covered Source 3.1 You may Convey verbatim copies of the Covered Source in any medium, provided You retain all Notices. 3.2 You may Convey Covered Source, with or without modification, provided that You: a) retain Notices as required under section 3.1; b) add a Notice to the modified Covered Source stating that You have modified it, with the date and brief description of how You have modified it; c) add a Notice to the Covered Source prominently stating that it is available under this Licence, with the text of, or the URL or address of, this Licence; d) make the Covered Source (including any modifications) and any Notices available under the terms of this Licence to anyone who comes into possession of the Covered Source. 3.3 You may only Convey Covered Source under the terms of this Licence. You may not impose any further restrictions on the exercise of the rights granted or affirmed under this Licence. 3.4 If You Convey Covered Source You must provide to each recipient a written offer valid for three years, or for as long as You Convey the Product, to give anyone who comes into possession of the Covered Source a copy of the Covered Source at no charge with the rights conferred by this Licence. 3.5 You may incorporate the Covered Source into a larger work, provided that the larger work contains Covered Source under this Licence and is released under a Compatible Licence. 3.6 You may not apply legal terms or technological measures that legally restrict a recipient from exercising any right granted under this Licence. 4 Conditions for Making Products 4.1 You may Make Products, and Convey them to anyone, provided that: a) You ensure that each Product which You Make contains and displays the following Notice prominently: "This Product is based on Covered Source licensed under the CERN-OHL-S v2 (https://ohwr.org/cern_ohl_s_v2.txt) by [name of Licensor] and others." b) You make the Covered Source (including any Modifications made by You) and any Notices available under the terms of this Licence to anyone who comes into possession of the Product. 4.2 If You Make a Product which incorporates External Material not covered by any of the rights granted under this Licence, You must ensure that such External Material is clearly identified as such in the Product. 5 Notices 5.1 You must retain all Notices as provided in the Covered Source, including in particular the copyright, authorship and contribution Notices. 5.2 If it is not possible to retain Notices in a particular form (such as a physical label), You must instead provide such Notices in a form that is reasonable in the circumstances, for example in the Product documentation. 6 No Warranty COVERED SOURCE AND ANY PRODUCTS MADE FROM IT ARE PROVIDED 'AS IS' AND ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE DISCLAIMED IN FAVOUR OF THE LICENSOR AND ANY OTHER CONTRIBUTORS. THIS DISCLAIMER OF WARRANTY IS AN ESSENTIAL PART OF THIS LICENCE AND A CONDITION FOR THE GRANT OF ANY RIGHTS GRANTED HEREUNDER. 7 Liability 7.1 As far as the law allows, the Licensor and any Contributor will have no liability for any direct, indirect, special, incidental, consequential or punitive damages of any character arising as a result of this Licence or the use of the Covered Source or any Products made therefrom, even if advised of the possibility of such damages, and You agree that this is an essential part of this Licence. 7.2 Nothing in this Licence shall be taken as an assurance by the Licensor or any Contributor that the Covered Source or any Products made therefrom will not infringe the rights of third parties. 8 Patents 8.1 Subject to the terms and conditions of this Licence, each Licensor hereby grants to You a perpetual, worldwide, non-exclusive, no-charge, royalty-free, irrevocable (except as stated in subsections 8.2 and 8.3) patent licence to Make, have Made, use, offer to sell, sell, import, and otherwise transfer the Covered Source and Products made therefrom, where such licence applies only to those patent claims licensable by such Licensor that are necessarily infringed by exercising rights under the Covered Source as Conveyed by that Licensor. 8.2 If You institute patent litigation against any entity (including a cross-claim or counterclaim in a lawsuit) alleging that the Covered Source or a Product made therefrom constitutes direct or contributory patent infringement, then any patent licences granted to You under this Licence for the Covered Source shall terminate as of the date such litigation is filed. 8.3 If You Assert a patent claim against a Licensor or Contributor alleging that the Covered Source or a Product made therefrom constitutes direct or contributory patent infringement, then, in addition to the termination of patent licences provided for in section 8.2, the Licensor may terminate this Licence with immediate effect. The Licensor must send You written notice of such termination within sixty (60) days of the date of such assertion. 9 General 9.1 If any provision of this Licence is or becomes illegal, invalid or unenforceable in any jurisdiction, this shall not affect the legality, validity or enforceability of the remaining provisions of this Licence, which shall remain in full force and effect. 9.2 Where Your right to use the Covered Source depends on Your compliance with this Licence and You fail to comply with any of its terms, You lose the rights granted to You under this Licence. If You subsequently comply with the terms, the rights may be reinstated with the explicit written permission of the Licensor. 9.3 This Licence shall terminate with immediate effect if You fail to comply with any of its material terms and conditions.
